HTC One faces sales ban following Nokia patent win

Nokia has indicated that it plans to seek a injunction banning rival HTC from importing and selling its smartphone products into the UK, following a court ruling which claims HTC infringed a Nokia patent.


The ruling, made in the Patents Court last night, claims that HTC has infringed on a Nokia-held patent entitled "Modulator Structure for a Transmitter and a Mobile Station" in the design of its smartphones. As a result of the ruling, Nokia is now free to seek recompense - and while it will be asking for cash, it's also looking to prevent HTC from selling any infringing products.


"Today's judgement is a significant development in our dispute with HTC" a Nokia spokesperson told press following the court's ruling. "Nokia will now seek an injunction against the import and sale of infringing HTC products in the UK, as well as financial compensation."


HTC, naturally, is contesting the ruling and plans to file an appeal - but, if Nokia is successful, could see numerous products banned from sale in the UK. The patent, Nokia claimed, covers a number of HTC's most recent products including its flagship HTC One Android-based smartphone.


The same patent which has been upheld by the UK Patents Court is also the focus of similar suits against HTC in Germany, Italy, the US and Japan, while other patents are being used to seek similar injunctions in France and the Netherlands.
